Avellar Law has not, in the last twelve (12) months, sold or shared consumers’ personal information for purposes of cross-context behavioral advertising (advertising that is targeted to you based on personal information obtained from your activity across businesses, distinctly branded internet websites, applications, or services).

7. Use or Disclosure of Sensitive Personal Information
Avellar Law does not use or disclose your sensitive personal information for purposes other than those listed below:

To prevent, detect, and investigate security incidents that compromise the availability, authenticity, integrity, or confidentiality of stored or transmitted personal information.

To resist malicious, deceptive, fraudulent, or illegal actions directed at the business and to prosecute those responsible for those actions.

8. Your Rights
Under various state laws, you may have the right to request access to, and deletion of the personal information Avellar Law collects about you, as well as to request that Avellar Law disclose how it collects, uses, and shares your personal information.
8.1. Right to Know
You have a right to know what personal information Avellar Law has collected about you, including:

The categories of third parties to whom Avellar Law discloses personal information; and

8.2. Right to Delete
You have a right to delete personal information Avellar Law has collected from you, subject to certain exceptions, including where the information is necessary to complete a transaction with you. Subject to the exceptions set out in Section 8.3 on receipt of a verifiable request from you, Avellar Law shall:

Delete your personal information from Avellar Law’s records;

Direct any service providers or contractors to delete your personal information from their records; and

Direct third parties to whom the business has sold or shared your personal information to delete your personal information unless this proves impossible or involves disproportionate effort.
8.3. Exceptions to Right to Delete
Please note that Avellar Law may not delete your personal information if it is necessary to:

Complete the transaction for which the personal information was collected, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, provide a good or service requested by you, or reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform a contract between you and Avellar Law;

Help to ensure security and integrity to the extent the use of the consumer's personal information is reasonably necessary and proportionate for those purposes;

Debug to identify and repair errors that impair existing intended functionality;

Exercise free speech, ensure the right of another consumer to exercise their right of free speech, or exercise another right provided for by law;

Comply with the California Electronic Communications Privacy Act or any other applicable state law;

Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when Avellar Law’s deletion of the information is likely to render impossible or seriously impair the achievement of such research, provided Avellar Law has obtained your informed consent;

Enable solely internal uses that are reasonably aligned with your expectations based on your relationship with Avellar Law;

Comply with an existing legal obligation; or
-
Otherwise use your personal information, internally, in a lawful manner that is compatible with the context in which you provided the information.
8.4. Right to Correct Inaccurate Personal Information
Upon receipt of a verifiable request from you, Avellar Law shall use commercially reasonable efforts to correct the inaccurate personal information.
8.5. Right not to Receive Discriminatory Treatment
You have a right not to receive discriminatory treatment for exercising any of these rights listed in this Section 8. This means Avellar Law cannot, among other things:

Deny goods or services to you;

Charge different prices or rates for goods or services, including using discounts or other benefits or imposing penalties;

Provide a different level or quality of goods or services to you; or
-
Suggest that you will receive a different price or rate for goods or services or a different level or quality of goods or services.
Please note that Avellar Law may charge a different price or rate or provide a different level or quality of services to you, if that difference is reasonably related to the value provided to Avellar Law’s business by your personal information.
9. Exercising Your Rights
You can submit a request to exercise your rights to access, correct, or delete your personal information by sending an email to delete@avellarlaw.com and providing Avellar Law with your name, address, phone number, and email.
Avellar Law will need your contact information, including your name, address, phone number, and email, to verify your identity for access, correction, or deletion requests. Avellar Law’s verification process may also include asking you to answer a few questions about yourself to help Avellar Law verify your identity. Avellar Law is not obligated to make a data access or data portability disclosure if Avellar Law cannot verify that the person making the request is the person about whom Avellar Law collected information or is someone authorized to act on such person's behalf. Any personal information Avellar Law collects from you to verify your identity in connection with your request will be used solely for the purposes of verification.
If you are an authorized agent, then you will be required to submit your contact information and a certification form as well as provide information about the consumer for whom you are making a request.
10. Security
Avellar Law has implemented security measures designed to protect your personal information.
Regardless of Avellar Law’s measures and efforts, Avellar Law cannot and does not guarantee the absolute protection and security of your personal information or any other information you upload, publish, or otherwise share with Avellar Law or anyone else. Avellar Law encourages you to avoid providing it—or anyone with else—with any sensitive personal information that Avellar Law does not require.
11. Updates to this Policy
Avellar Law may update this Privacy Policy as required by applicable law and to reflect changes to Avellar Law’s practices regarding the collection, storage, and usage of personal information.
